1. Introduction

These Terms and Conditions ("Agreement") govern the use of parking services provided by Pedaly AB (Reg. No.: 559243–7999), hereafter referred to as "Pedaly," "we," or "us." By accessing or using any of Pedaly’s infrastructure, mobile applications, or digital platforms, you ("User") agree to be bound by these Terms.

Pedaly offers access-based parking solutions primarily in Sweden, including secure parking stations for bicycles, scooters, and similar personal vehicles. These services are delivered through physical infrastructure and digital systems, including but not limited to mobile applications, QR-code readers, and RFID/NFC-based access technologies.

2. Definitions

  • Service: Access to Pedaly's digital parking infrastructure, including any accompanying features in the Pedaly App.

  • User: Any individual who uses or accesses the Pedaly Service.

  • Pedaly App: The mobile application developed and operated by Pedaly.

  • Infrastructure: Pedaly’s physical parking solutions and associated systems (e.g., locks, gates, electronic interfaces).

3. Access and Registration

To use the Service, Users may need to:

  • Register an account in the Pedaly App with accurate information

  • Accept these Terms and our Privacy Policy

  • Access the parking infrastructure using the Pedaly App, RFID/NFC card, QR code, or other approved methods

The User is responsible for maintaining the security of their account credentials and ensuring all actions taken under their account comply with these Terms.

4. Scope of Service

Pedaly provides digital access to secure parking infrastructure for personal vehicles such as bicycles and scooters. The service allows Users to:

  • Locate available parking spaces using the Pedaly App

  • Lock and unlock designated parking units using authorized methods

  • Park personal vehicles temporarily or for longer durations depending on availability

5. Use of the Service

Users agree to:

  • Only use the parking infrastructure for its intended purpose

  • Ensure the parked vehicle is fully secured and correctly placed, in accordance with any specific instructions displayed on-site, in the Pedaly App, or on the parking unit itself

  • Follow local regulations, on-site signage, and instructions in the Pedaly App

  • Avoid causing obstruction or damage to other users or property

The User must not:

  • Tamper with or modify any part of the Pedaly infrastructure

  • Use the infrastructure for storing items other than personal vehicles

  • Share access credentials with unauthorized persons

6. Availability

Pedaly does not guarantee availability of parking spaces at any given time or location. Availability may vary based on demand, maintenance, technical issues, or third-party involvement.

7. Fees and Payments

Some Pedaly parking services are free of charge, while others may require payment. Any applicable fees are clearly displayed in the Pedaly App or related platform before use.

Accepted payment methods include:

  • Credit/debit card

  • Prepaid balance (if available)

  • Sponsored access through a third party (e.g., municipality or employer)

By using a paid service, the User agrees to pay all displayed fees. Pedaly reserves the right to update pricing at any time.

8. Refunds

Refunds may be granted under the following circumstances:

  • Technical failure prevents access to or use of the infrastructure

  • Incorrect billing or unauthorized charges

Refund requests must be submitted to contact@pedaly.se within 30 days. Pedaly will review and respond within five (5) business days.

9. Responsibility and Limitations

Pedaly Is Responsible For:

  • Providing functioning digital and physical infrastructure

  • Maintaining reasonable levels of service availability

  • Securing payment processing and account data

  • Handling user data in accordance with GDPR

Pedaly Is Not Responsible For:

  • Theft, loss, or damage to parked vehicles or personal belongings

  • Improper use of infrastructure by Users or third parties

  • Delays or service interruptions due to force majeure, vandalism, or external systems

Users use the Pedaly Service at their own risk and are advised to take reasonable precautions (e.g., using personal locks or insurance).

10. User Conduct

Users must:

  • Park responsibly and within designated spaces

  • Avoid blocking access for others

  • Immediately report damages, issues, or unauthorized use

  • Respect Pedaly property and third-party facilities

Violations may result in temporary or permanent suspension of access to Pedaly’s services.

11. Data Protection

Pedaly processes personal data in compliance with the General Data Protection Regulation (GDPR). By creating an account or using Pedaly services, Users consent to the collection and processing of their personal data as outlined in our Privacy Policy.

12. Modifications to the Terms

Pedaly may modify these Terms at any time. Changes will be published via the Pedaly App, website, or other communication channels. Continued use of the service following such updates constitutes acceptance of the revised Terms.

13. Termination

Pedaly may suspend or terminate a User’s account at any time if:

  • The User breaches these Terms

  • Fraud, misuse, or illegal activity is suspected

  • Payment obligations are not met

14. Governing Law

This Agreement is governed by Swedish law. Any dispute arising from or related to these Terms shall be resolved in the courts of Sweden, unless otherwise required by applicable mandatory law.
